ABORTION IS BANNED IN IDAHO AS OF AUGUST 25, 2022
Abortion is completely banned in Idaho with very limited exceptions because of a new Idaho law that went into effect August 25, 2022. If you’re in Idaho, you’ll need to travel out of Idaho to get an abortion unless you qualify for an exception. Exceptions are very limited and include:
- To save the pregnant person’s life
- If the pregnancy is a result of rape and/or incest.
It is legal for you to leave Idaho and get an abortion out of state.

The Northwest Abortion Access Fund: The Northwest Abortion Access Fund is an abortion fund serving Washington, Oregon, Idaho, and Alaska. Trained, compassionate volunteer advocates run our toll-free hotline. They will help people pay for their abortion care by sending funding directly to the clinic. They also help people get to and from the clinic. And they make sure people traveling for care have a safe place to stay.
HOW TO LEGALLY GET AN ABORTION WITHOUT YOUR PARENT’S PERMISSION:
Not everyone can tell their parent about their decision to have an abortion. If you cannot or choose not to talk to your parent, there is another option called a judicial bypass. A judicial bypass means asking a judge to allow you to get an abortion without telling your parent.
This is a legal process that a lawyer will help you with. Your lawyer’s job is to represent you in court. That means they are there to help you ask for what you want. Even if the lawyer was given to you by the court, it is your lawyer’s job to help you ask the court for what you want.
Idaho is one of the states that has a dedicated group of advocates working to help young people who need a judicial bypass.
Planned Parenthood runs a free hotline (1-800-230-7526) to help young people through the judicial bypass process. When you call the hotline, Planned Parenthood will provide more information on how to get a judicial bypass and answer your questions. You can visit the website for Planned Parenthood of Idaho here.
With the help of a lawyer, you will ask for a judicial bypass by submitting a document called a petition to the court. After that, the judge will schedule a hearing. The hearing will happen within 2 days after you turn in the petition, not including weekends and holidays.
You could also consider looking into having an abortion in a nearby state like Washington, which does not require parental consent and does not have a waiting period before you can have an abortion.
KNOW YOUR RIGHTS ON JURY NULLIFICATION:
Jury nullification occurs when a jury returns a verdict of “Not Guilty” despite its belief that the defendant is guilty of the violation charged. The jury in effect nullifies a law that it believes is either immoral or wrongly applied to the defendant whose fate they are charged with deciding.
There is no requirement that jurors must come to a unanimous verdict. If the jury cannot unanimously agree on a verdict of either Guilty or Not Guilty, this is known as a hung jury. When further deliberation clearly will be unproductive, the judge will declare a mistrial. The prosecution may or may not retry the case in the future, but the law has at least been nullified in the trial at hand.
If you find yourself on a jury that is going to trial, never mention jury nullification during the juror screening process and then APPLY JURY NULLIFICATION TO PRESERVE WOMEN’S RIGHTS.
